1. Purpose
This policy supplements our Terms of Service. Violations may result in suspension or termination of your account, removal of content, and/or legal action.
2. Prohibited content and activities
2.1 Illegal activity
- Violations of any applicable law, regulation, or court order.
- Trafficking, exploitation, terrorism, money laundering, sanctions evasion.
- Selling controlled substances, weapons, or other illegal goods through the Service.
2.2 Spam and unsolicited communications
- Sending unsolicited bulk messages (email, SMS, WhatsApp, push, in-app).
- Violating CAN-SPAM, CASL, GDPR, TCPA, or other electronic-communications laws.
- Sending messages without prior consent of recipients when consent is required.
- Failing to provide functional opt-out/unsubscribe mechanisms.
- Purchasing or scraping email/phone lists.
2.3 Harmful or abusive behavior
- Harassment, threats, doxxing, stalking, intimidation.
- Hate speech, incitement to violence, discrimination based on protected characteristics.
- Sexual content involving minors (zero tolerance; we report to authorities).
- Non-consensual intimate imagery.
- Promoting self-harm or suicide.
2.4 Fraud and deception
- Phishing, scams, fake identities, impersonation.
- Misrepresenting affiliation with SHAART or any third party.
- Manipulating prices, reviews, or analytics.
- Bait-and-switch listings or false advertising.
2.5 Security threats
- Distributing malware, ransomware, viruses, or harmful code.
- Unauthorized access to systems or accounts (yours or others').
- Attempting to bypass authentication, rate limits, or other security controls.
- Penetration testing without prior written authorization from us.
- Denial-of-service attacks (volumetric or application-layer) against the Service or third parties.
2.6 Intellectual property infringement
- Uploading or distributing content you do not have rights to.
- Removing copyright notices or watermarks without authorization.
- Counterfeit goods or trademark infringement.
- Circumventing DRM or technological protection measures.
2.7 Privacy violations
- Collecting personal information without lawful basis or required consent.
- Sharing personal information without authorization.
- Processing special category data (health, biometric, religious, sexual orientation, etc.) without explicit lawful basis.
- Failing to honor data subject rights (access, deletion, opt-out).
2.8 Platform abuse
- Reselling Service access without our written consent.
- Reverse engineering, decompiling, or scraping the Service beyond documented APIs.
- Creating multiple accounts to evade limits, suspensions, or bans.
- Sharing account credentials beyond authorized team members.
- Excessive API or resource usage that degrades Service for other customers.
- Using AI features to generate content prohibited by this policy.
2.9 Inappropriate content
- Explicit sexual content unless lawfully published in jurisdictions where allowed AND clearly labeled.
- Gratuitous violence or gore.
- Content promoting dangerous or illegal activities.
3. High-risk use cases
The Service is not designed for and you must not use it in:
- Medical diagnosis, treatment, or any FDA-regulated activity (without our explicit written approval).
- Operation of nuclear facilities, life-support, aircraft navigation, or military weapons systems.
- Activities where Service failure could lead to death, injury, or environmental damage.
4. WhatsApp and messaging compliance
When using messaging features (WhatsApp, SMS, email):
- You must have prior consent from each recipient as required by applicable law.
- You must honor opt-outs immediately.
- You must comply with Meta's WhatsApp Business Solution Terms and WhatsApp Messaging Policy.
- You must not use the Service to violate carrier policies or trigger abuse signals.
- You are responsible for the content you send through the Service.
5. AI use
- Do not use AI to generate prohibited content.
- Do not attempt to extract or reverse engineer underlying models.
- Do not represent AI outputs as authoritative for legal, medical, financial, or other regulated advice.
- Do not use AI to impersonate real people without consent.
6. Reporting violations
If you observe violations of this policy, report them to legal@shaartusa.com with as much detail as possible.
7. Enforcement
We may, at our sole discretion:
- Issue a warning.
- Remove offending content.
- Suspend or terminate the account.
- Disable specific features (e.g., outbound messaging).
- Report illegal activity to law enforcement.
- Pursue legal remedies.
For severe or repeated violations, we may take immediate action without prior notice.
8. Appeals
If your account is suspended or terminated, you may appeal to legal@shaartusa.com within 30 days. We will review in good faith but reserve final discretion.
9. Updates
We may update this policy. Material changes effective 30 days after notice.
